General terms and conditions of sale

The website www.stash.ad is owned by Born to Live, SLU (hereinafter BTL), a company registered in the Principality of Andorra at Avinguda Verge de Canòlich, 27, Sant Julià de Lòria, under Registry number 19535, book S-310, folios 351-360, registered on 22 September 2020. Born to Live, SLU also has a permanent establishment in Spain with tax domicile at Carrer Major, 6, La Seu d’Urgell 25700 Lleida, Tax ID N0029015E. Company registered in the Commercial Registry under number 19535, book S-310, folios 351-360, on 15 September 2020. Signing up on the website implies both acceptance of the terms and conditions of sale and confirmation that the customer has read and accepted these conditions.

Preamble

These general terms and conditions define the rights and obligations of both parties, in the context of renting lockers to temporarily store packages.

Confirmation of service sign-up

Once the user has signed up, they will receive an email at the address provided.

Confirmation and proof of payment

Records stored on the website, under reasonable security conditions, are considered reliable proof of communications, locker booking and payment between both parties.

General terms of use

Through its website, BTL provides package storage at its facilities at Carrer Major, 6, La Seu d’Urgell, until the customer collects the goods using a delivery code. BTL contractually offers a package storage and safekeeping service. The company is under no circumstances responsible for the contents of a package: it is the sole responsibility of the sender and recipient to know the legal regulations regarding illegal or prohibited products. BTL is not responsible for any damage to packages. The company keeps continuous recordings stored for 7 days that may be used as evidence in the event of a dispute or claim -- the time to review the recordings is limited to those 7 days from the date of delivery or collection. The premises are equipped with security cameras; entry implies the user’s (sender’s or recipient’s) acceptance of being filmed, stored and disclosed if necessary, solely for reasons of claims or litigation.

Locker size

The locker configuration is designed to store most packages. However, some packages may exceed the maximum dimensions of the XL lockers; in that case BTL will not be responsible for storing the package, and the courier will deliver it directly to the user from their own premises. BTL rents the locker to the customer according to its volume: the usable space of each locker is rented, regardless of the number of packages in the order.

Collection deadline

The maximum time to collect the goods is defined on the website. Once that time has elapsed, the system will send the customer a new code to collect the package within the stipulated period. Once that new period has also elapsed, the package will be withdrawn and kept at the customer’s disposal upon request to arrange collection through the website -- Stash will keep the package for 1 month, and reserves the right to charge for this storage for up to 1 month from notifying the customer, at the price set on the website. After this 1-month period, the customer will receive an email notification warning that, if no response is received within one week, the package will be destroyed with no possibility of claiming any compensation from the company.

Validity of offers, service prices and taxes

Special offers, promotions or discounts are valid until the date indicated. Prices shown are valid at the time of viewing the website, and include VAT as a service rendered in Spain.

Payment and invoices

Payment for the service is made by VISA or Mastercard credit card. No refunds are accepted after 15 days from contracting the service. If you would like an invoice, as an individual or business customer, you may request it through the website.

Shipping costs and delivery times

BTL has no involvement in price negotiations, whether for the product itself, shipping, taxes or any other charge. BTL is likewise not responsible for agreed delivery times or other conditions: in the event of a delivery delay, it is the logistics company or the sender who must respond to the customer, with BTL bearing no responsibility.

Package types

Stash stores the packages requested by the customer inside the lockers until collection. The company is under no circumstances responsible for, nor has information about, the nature of the shipments, and reminds users that sending prohibited or illegal products, or products that do not comply with current legislation, is forbidden.

Delivery errors

In the event of delivery errors, whatever their nature or origin, BTL will neither return nor refund the amount of its service to the customer.

Acceptance of the terms

The customer declares that they accept the aforementioned terms and that their personal data may be stored on the website. For more information, please see our privacy policy.

Governing law

In general, the relationship between BTL, S.L.U. and the users of its telematic services is subject to Spanish law and jurisdiction.

Customer use and access

The customer acknowledges and accepts that accessing the website’s content does not, under any circumstances, constitute the start of a business relationship with BTL until the purchase is confirmed, and under no circumstances constitutes legal or professional advice.

Intellectual property

The intellectual property rights over the website’s content, design and code belong to Born To Live, SLU; reproduction, distribution, public communication or any other use of the website’s content is prohibited, even citing the source, unless BTL expressly authorises it. Downloading logos or corporate imagery is excluded from this restriction provided the style guide and proportionality are respected, as is linking to the website from other platforms for promotional or advertising purposes.

Website content and links

Born To Live, SLU reserves the right to update, modify or remove the information contained on this website, and may even restrict or deny certain users’ access to that information. Born To Live, S.L.U. assumes no responsibility for third-party information that may be accessed via indirect links from any location.

Delivery of goods

It is the logistics company, or by extension the sender, who delivers the goods and chooses the locker according to its volume. By accepting the terms of use, the customer delegates to Stash the acceptance and confirmation of delivery via a delivery note sent to the logistics operator by email.

Right to image and security

The customer is aware of and accepts that the premises have continuous filming and other security measures such as fire and humidity sensors. In the event of a dispute between any of the 3 parties involved (customer, courier or Stash), the company may use the images recorded inside the premises whenever they are required within a technically reasonable period and in a reliable manner.

Privacy policy

In compliance with personal data protection regulations, we inform you that your data will be incorporated into and processed in the files of BORN TO LIVE, S.L.U., for the purpose of managing, administering and maintaining the services provided and/or contracted, as well as to keep the customer informed about matters relating to the company’s activity and services. In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), we inform you of the following:

  • Personal data is the responsibility of BORN TO LIVE, S.L.U, located at C/ Major, 6, 25700 La Seu d’Urgell. Phone/WhatsApp/Telegram contact: +34 620 573 006, email btl@grauvell.com.
  • The purpose of the processing is to manage the data for accounting, tax, advertising and commercial prospecting purposes that you authorise.
  • The data will be kept for as long as the relationship between both parties lasts. Once the relationship has ended, only data required by law will be kept.
  • The legal basis for processing is the consent given by you; you have the right to withdraw this consent at any time.
  • The data processed is not transferred to third parties, except where legally required.
  • You have the right to request access to your data, and its rectification, deletion or restriction of processing, in writing to Born To Live, S.L.U., C/ Major, 6, 25700 La Seu d’Urgell (Lleida, Spain).

Cookies policy

  1. We may store information about your computer, including your IP address, operating system and browser, for system administration purposes. This is statistical data about how you browse our website.
  2. For the same reason, we may obtain information about your general internet use through a cookie file stored on your computer’s hard drive.
  3. Cookies help us improve our website and provide a better service: estimating numbers and usage patterns, storing your preferences, speeding up searches, and recognising you when you return to our website.
  4. You may refuse to accept cookies by enabling the corresponding setting in your browser. If you do so, you may not be able to access certain parts of the website or make use of some services. Unless you have configured your browser not to accept them, our system will generate cookies when you connect to our website.
